Do you need a German VAT number?

  1. Your goods sit in a German warehouse (Amazon FBA in Germany, Pan-European FBA, or a German 3PL): yes, from the first unit.
    • Moving your own stock into Germany counts as a taxable acquisition there (intra-Community acquisition, innergemeinschaftlicher Erwerb).
    • Your sales from that stock to German customers carry German VAT.
    • There is no threshold.
  2. You ship from your home country straight to German consumers:
    • Below €10,000 a year in cross-border sales to consumers across the whole EU, your home country's VAT applies.
    • Above it, German VAT applies, and you can declare it through the EU One-Stop-Shop (OSS) in your home country instead of registering in Germany.
  3. You sell only to German businesses from your home stock: usually no German registration. The sale is an intra-Community supply and the buyer accounts for the VAT.

Amazon is the "deemed supplier" that collects VAT for you only for sellers based outside the EU. As an EU company you stay the seller and you file.

Do I need a German VAT number if I already have one in my own EU country?

Yes, if your goods are stored in Germany. Your home VAT ID does not cover sales from German stock.

Do I need a fiscal representative?

No. An EU company registers in its own name; a German tax advisor acting for you is enough.

Can I use the One-Stop-Shop (OSS) instead?

Only for goods you ship from your home country to consumers in Germany. Sales from German stock always go on a German return.

How long does it take?
